Dear Mr Prosecutor,
The referral of the situation in Darfur to the International Criminal Court (ICC) by the UN Security Council earlier this year was an important step forward in the quest for justice in Sudan. A culture of impunity had contributed significantly to the prolongation of the violence and the commencement of an investigation by the ICC was welcomed by many in Darfur as both a signal of international solidarity and a necessary complement to justice efforts at a national level in Sudan.
While we recognize that your team has been diligently investigating the situation, it is time for the people of Darfur and Sudan to see justice being done. We therefore strongly urge you to announce that you will travel to Sudan and meet publicly with the Government of Sudan, civil society and the public.
Despite an initial diminution in the intensity of the conflict in the wake of the referral, little has changed for the people on the ground in Darfur. With fighting renewed between the parties, civilians are being deliberately targeted for attack, aid workers kidnapped and thousands newly forced from their homes. General insecurity is again on the rise.
We acknowledge that the context in Darfur presents many challenges for the Court.
The investigation in Darfur, triggered by the UN Security Council, has created an environment where there is at once huge expectation, apprehension and misunderstanding about the mandate of the ICC and its implications in Sudan.
Your presence in Sudan will provide an essential opportunity for you to present the functions and limitations of the Court, and to transparently outline the expected scope and conduct of the investigation for the people of Darfur and Sudan.
